Welcome to UpCreators, the French platform dedicated to User Generated Content (UGC). These Terms and Conditions govern access to and use of the UpCreators platform.

1. Purpose

UpCreators is a platform connecting brands with content creators for the production of authentic content campaigns (videos, photos, and other media).

The platform enables:

  • Brands: to post campaigns and find creators
  • Creators: to apply to campaigns and get paid for their content
  • Facilitating exchanges, managing campaigns, and delivering media

2. Acceptance of Terms

By accessing the UpCreators platform, you unconditionally accept these Terms and Conditions. If you do not accept these terms, please do not use the platform.

3. Registration and User Account

3.1 Registration Requirements

  • You must be at least 18 years old
  • You must provide accurate and complete information
  • You are responsible for the confidentiality of your login credentials

3.2 Account Types

  • Creator Account: for content creators
  • Brand Account: for businesses and advertisers

3.3 Responsibilities

You agree to:

  • Keep your information up to date
  • Not share your login credentials
  • Notify us of any unauthorized use of your account

4. Platform Usage

4.1 For Brands

Brands can:

  • Create and publish campaigns
  • View creator profiles
  • Select creators for their campaigns
  • Manage payments through the platform

4.2 For Creators

Creators can:

  • Create a professional profile
  • Apply to published campaigns
  • Deliver content according to briefs
  • Receive payments for their work

5. Campaigns and Content

5.1 Campaign Briefs

Brands must provide clear briefs including:

  • The nature of the expected content
  • Delivery deadlines
  • The proposed compensation
  • Content usage rights

5.2 Content Delivery

Creators commit to:

  • Respect briefs and agreed deadlines
  • Deliver original and quality content
  • Not use content protected by third-party rights

5.3 Intellectual Property

Usage rights for created content are defined in each campaign brief. By default, creators retain ownership of their content and grant brands a usage license according to negotiated terms.

6. Payments and Compensation

6.1 Payment Terms

  • Payments are processed through the platform
  • UpCreators takes a commission on each transaction
  • Creators receive payment after content validation by the brand

6.2 Invoicing

  • Creators must provide necessary tax information
  • Each transaction is documented with an invoice or receipt

6.3 Refunds

Refund conditions are determined on a case-by-case basis depending on the conformity of delivered content.

7. Obligations and Prohibitions

7.1 You agree to

  • Comply with applicable laws and regulations
  • Provide authentic and original content
  • Not infringe on third-party rights
  • Communicate respectfully

7.2 It is strictly prohibited to

  • Post illegal, defamatory, or offensive content
  • Use the platform for fraudulent purposes
  • Bypass the platform's payment systems
  • Harass or discriminate against other users
  • Copy or reproduce protected content

8. Liabilities

8.1 UpCreators' Liability

UpCreators commits to:

  • Maintain the platform accessible and functional
  • Protect users' personal data
  • Facilitate dispute resolution between users

UpCreators cannot be held liable for:

  • The quality of relationships between brands and creators
  • Content created by users
  • Financial losses resulting from transactions between users

8.2 User Liability

Each user is responsible for:

  • Their publications and communications
  • Compliance with their contractual commitments
  • Tax and social consequences of their activity

9. Data Protection

UpCreators is committed to protecting your personal data in accordance with GDPR and our Privacy Policy. Your data is used solely for platform operations.

10. Suspension and Termination

10.1 Account Suspension

UpCreators reserves the right to suspend or delete any account in case of:

  • Violation of these Terms and Conditions
  • Fraudulent or illegal activity
  • Abusive behavior towards other users

10.2 Voluntary Termination

You can delete your account at any time from your profile settings.

11. Modifications to Terms and Conditions

UpCreators reserves the right to modify these Terms and Conditions at any time. Users will be notified of significant changes by email. Continued use of the platform after modifications constitutes acceptance of the new terms.

12. Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of French courts.
